These Terms of Use (“Terms”) constitute a legally binding agreement between you (“you” or “user”) and American Friends of Gal Einai (“we,” “us,” or “our”), the operator of Binah, an AI-powered spiritual companion accessible at binah.inner.org and via WhatsApp (collectively, the “Service”).

The Service is intended for individuals who are at least 18 years of age. By using the Service, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.
Binah is an AI-powered spiritual companion that provides guidance rooted in Torah, Chassidic, and Kabbalistic teachings, centered on the works of Rabbi Yitzchak Ginsburgh. The Service draws from a library of over 15,000 books, lectures, and Torah sources to generate responses to your questions.
The Service is available via the website at binah.inner.org and, for subscribers, via WhatsApp.

We reserve the right to suspend or terminate your account if any information you provide is inaccurate, misleading, or incomplete, or if your use violates these Terms.
The Service offers the following paid subscription tiers:
Subscriptions are billed on a recurring monthly basis. By subscribing, you authorize us to charge your chosen payment method on a recurring basis until you cancel. We accept Visa, Mastercard, and American Express via Stripe.
We reserve the right to change pricing at any time. Price changes will take effect at the start of your next billing cycle. We will provide reasonable notice of any price changes.
We offer a free tier that provides up to 30 messages per month via the website. No credit card or payment information is required for the free tier. The free tier is subject to change or discontinuation at our discretion.
You may cancel your subscription at any time through your account settings. Your cancellation will take effect at the end of the current billing period, and you will retain access to paid features until that date.

All content, design, software, trademarks, logos, and other intellectual property associated with the Service (excluding user content) are owned by or licensed to American Friends of Gal Einai and are protected by applicable intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial purposes in accordance with these Terms.
The underlying Torah teachings, books, and lectures that inform Binah’s responses remain the intellectual property of their respective authors and publishers. AI-generated responses are summaries and interpretations and should not be treated as verbatim reproductions of source material.
You retain ownership of the content you submit through the Service (your questions and messages). By using the Service, you grant us a limited license to process your content solely for the purposes of:
Your individual chat data will never be used to train AI models and will never be shared with any third party. Your conversations are strictly confidential and are used solely to provide the Service to you.
The Service integrates with third-party services including Google Firebase, Stripe, WhatsApp (Meta), SendGrid (Twilio), and Google Cloud Platform. Your use of these third-party services is subject to their respective terms and privacy policies.
We are not responsible for the practices, content, or availability of third-party services. Any issues arising from third-party services should be directed to the respective provider.

The Service is hosted in the United States. If you access the Service from outside the United States, you consent to the transfer and processing of your data in the United States.

Our total aggregate liability for all claims arising out of or relating to these Terms or the Service shall not exceed the amount you paid us in the one (1) month preceding the event giving rise to the claim, or fifty dollars ($50), whichever is greater.

Any legal action or proceeding arising out of or relating to these Terms shall be brought exclusively in the state or federal courts located in New York County, New York. You consent to the personal jurisdiction and venue of such courts and waive any objection based on forum non conveniens.
Any claim must be brought within one (1) year after the cause of action arises, or it is permanently barred.
By using the Service, you consent to receive electronic communications from us, including transactional messages (OTP codes, subscription confirmations) and, if you have opted in, promotional communications about the Service. You may opt out of promotional communications at any time by using the unsubscribe link in any email or by contacting us.
You agree that all agreements, notices, and communications provided electronically satisfy any legal requirement that such communications be in writing.
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision shall be severed and shall not affect the validity and enforceability of the remaining provisions.
